1. Agreement

These Terms of Service (“Terms”) form a binding agreement between you (“you”, “customer”) and Krystal Unity Pty Ltd (“Krystal Unity”, “we”, “us”) governing your use of any Krystal Unity service. By creating an account, accessing, or using any Krystal Unity product, you agree to these Terms and to the Privacy Policy incorporated by reference.

If you are entering into these Terms on behalf of an organisation, you represent that you have authority to bind that organisation, and “you” refers to that organisation.

2. Service description

Krystal Unity operates a portfolio of products including but not limited to KrystalView, Krystal Trace, FixLine, BlackDome, Krystal Reception, Krystal Clinic, Krystal Minting Hub, HIT CRM, Arena, and Grant Hunter. Each product has its own feature set, pricing, and additional product-specific terms that supplement these Terms. Where a product term conflicts with these umbrella Terms, the product-specific term governs for that product only.

3. Account responsibilities

  • You must provide accurate registration information and keep it current.
  • You are responsible for maintaining the confidentiality of your account credentials and API keys.
  • You are responsible for all activity that occurs under your account, including activity by team members and authorised agents.
  • You must notify us promptly of any suspected unauthorised access at security@krystalunity.com.
  • You must be at least 18 years of age, or the age of majority in your jurisdiction, to create a paid account.

4. Billing & payments

  • Subscription fees are billed in advance on a recurring basis as specified at signup.
  • Prices are listed in the currency shown at checkout. Australian customers are billed in AUD where indicated; otherwise USD.
  • All fees are exclusive of applicable taxes (GST, VAT, sales tax) which are added at checkout where required.
  • Payment is processed by Stripe; we do not store full card numbers.
  • Failed payments will be retried automatically. Continued non-payment may result in service suspension after reasonable notice.
  • Free-trial periods (where offered) automatically convert to paid subscriptions unless cancelled before the trial ends.
  • Refunds are at our discretion, except where required by applicable consumer protection law (including the Australian Consumer Law).
  • Usage-based fees (credits, message volumes, voice minutes) are billed in arrears or via prepaid packs, as configured per product.

5. Data ownership

You own your data. Krystal Unity makes no claim of ownership over the customer data you provide or generate through use of the services (“Customer Data”). You grant Krystal Unity a worldwide, non-exclusive licence to host, process, transmit, display, and back up Customer Data solely as required to deliver the services and to comply with the Privacy Policy.

You may export your Customer Data at any time during the subscription period through the relevant product console or via API. On termination, we will retain Customer Data for the period stated in the Privacy Policy and then permanently delete it.

6. Acceptable use

You may not use Krystal Unity services to violate law, infringe rights, or harm others. We will suspend or terminate accounts that do.

Specifically, you must not:

  • Use the services in violation of applicable law or regulation.
  • Infringe the intellectual property, privacy, or other rights of any third party.
  • Upload or transmit malware, ransomware, or other malicious code.
  • Interfere with, disrupt, or attempt to gain unauthorised access to any Krystal Unity system or to other customers' data.
  • Reverse engineer, decompile, or disassemble the services except to the extent permitted by applicable law.
  • Use the services to send unsolicited bulk communications (spam) or to operate phishing campaigns.
  • Use BlackDome telemetry, attacker IOCs, or honeypot data to harass, dox, or retaliate against individuals; threat intelligence may be used only for lawful defensive purposes.
  • Use KrystalView session replay to capture sensitive personal information without appropriate notice and consent on the recorded site.
  • Upload personal data to Krystal Trace or any other product without a lawful basis to do so under the applicable privacy law.

7. Service availability

We aim for high availability but do not guarantee uninterrupted operation. The services are provided on an “as available” basis. Planned maintenance will be announced in advance where practicable. Enterprise customers with a separate Service Level Agreement (SLA) are governed by the availability commitments in that SLA.

8. Third-party services

Some products integrate with third-party services (Google Ads, Stripe, Cliniko, MYOB, CartonCloud, Twilio, OpenAI, Anthropic, and others). Your use of those services is subject to their own terms and privacy policies, and Krystal Unity is not responsible for the operation of third-party services. 9. Intellectual property

Krystal Unity owns or licenses all rights in the services, including software, models, designs, documentation, branding, and all related intellectual property. We grant you a limited, non-exclusive, non-transferable licence to use the services for your internal business purposes during the subscription term, subject to these Terms.

Open-source components included in our software are licensed under their respective licences. Krystal Unity also publishes some open-source components (including the KrystalView MCP server at github.com/KrystalView/krystalview-mcp) under the licences stated in those repositories.

You retain ownership of any feedback, ideas, or suggestions you provide. We may use such feedback to improve the services without obligation to you.

10. Termination

You may terminate your subscription at any time through your account console or by contacting us. Termination is effective at the end of your current billing period unless otherwise specified.

We may suspend or terminate your account if you materially breach these Terms (including the acceptable-use provisions), if your payment is more than 30 days overdue, or if required to comply with law. Where practicable we will provide notice and opportunity to cure.

On termination, your right to use the services ends immediately. Sections that by their nature should survive termination (Data Ownership, IP, Liability, Indemnity, Governing Law) will survive.

11. Warranty disclaimer

To the maximum extent permitted by law, the services are provided “as is” and “as available” without warranties of any kind, express or implied, including but not limited to fitness for a particular purpose, merchantability, and non-infringement. AI-generated outputs (including diagnostic suggestions, redesign recommendations, blockchain trace reports, and threat assessments) are provided as decision-support tools only and do not constitute professional advice.

Nothing in these Terms excludes, restricts, or modifies any guarantee, right, or remedy you may have under the Australian Consumer Law or other applicable consumer protection law that cannot be excluded.

12. Limitation of liability

To the maximum extent permitted by law, Krystal Unity's total aggregate liability arising out of or related to these Terms or the services is limited to the fees paid by you in the twelve (12) months preceding the event giving rise to the claim. Krystal Unity will not be liable for indirect, incidental, special, consequential, or exemplary damages, including lost profits, lost data, or business interruption, even if advised of the possibility of such damages.

This limitation does not apply to liability that cannot be excluded under applicable law (including liability for fraud, gross negligence, or breach of consumer guarantees that cannot be excluded).

13. Indemnity

You agree to indemnify and hold Krystal Unity harmless from any claims arising out of your breach of these Terms, your misuse of the services, your violation of any third party's rights, or your violation of applicable law.

14. Governing law

These Terms are governed by the laws of New South Wales, Australia, without regard to conflict-of-law principles. The parties submit to the exclusive jurisdiction of the courts of New South Wales, Australia, except that either party may seek injunctive relief in any court of competent jurisdiction to protect its intellectual property.

15. Changes to these Terms

We may update these Terms from time to time. Material changes will be notified to registered customers by email or in-app notice at least 30 days before they take effect, except where a shorter period is required by law. Continued use of the services after the effective date constitutes acceptance of the updated Terms.
